Welcome to Whastafo. These Terms & Conditions (“Terms”) govern your access to and use of Whastafo, a WhatsApp API-based Software as a Service (SaaS) platform. By creating an account or using Whastafo, you agree to be bound by these Terms. If you do not agree, please do not use the platform. 1. Definitions “Whastafo” refers to the WhatsApp API SaaS platform operated by us. “User” refers to any individual or business using Whastafo. “Services” refer to messaging, automation, API tools, dashboards, and related features. “WhatsApp” refers to WhatsApp Business Platform by Meta. 2. Eligibility You must be 18 years or older to use Whastafo. You must provide accurate and complete registration information. Businesses must have the legal right to message customers. 3. Account Registration & Security Users are responsible for maintaining account confidentiality. You are responsible for all activities performed through your account. Unauthorized use must be reported immediately. Whastafo is not liable for losses due to compromised credentials. 4. Use of Services You agree to use Whastafo only for lawful purposes. ❌ Prohibited Use Includes: Spamming or bulk unsolicited messaging Messaging without user consent Fraud, scams, phishing, or misleading content Adult, illegal, hateful, or abusive content Violating WhatsApp or Meta policies Reselling or sublicensing without permission Violation may result in immediate suspension or termination. 5. WhatsApp API Compliance Users must comply with WhatsApp Business Platform Policies. Template approval and message delivery are subject to WhatsApp. Whastafo is not responsible for: Message rejections Account bans by WhatsApp Policy violations caused by user content 6. Subscription, Billing & Payments Whastafo operates on prepaid or subscription-based plans. All fees are non-refundable unless stated otherwise. Taxes (including GST) may apply as per law. Failure to pay may result in service suspension. 7. Data & Privacy User data is handled as per our Privacy Policy. Users retain ownership of their data. Whastafo may store logs for analytics, security, and compliance. 8. Service Availability We strive for maximum uptime but do not guarantee uninterrupted service. Maintenance, upgrades, or outages may occur. Whastafo is not liable for losses due to downtime or API failures. 9. Intellectual Property All software, branding, UI, and content belong to Whastafo. Users may not copy, modify, or reverse-engineer the platform. Unauthorized use of trademarks is prohibited. 10. Account Suspension & Termination Whastafo may suspend or terminate accounts if: Terms are violated WhatsApp policies are breached Illegal or harmful activities are detected Non-payment of dues Users may terminate their account at any time. 11. Limitation of Liability Whastafo shall not be liable for: Indirect or consequential damages WhatsApp account bans or restrictions Message delivery failures Business losses or revenue impact Use of the platform is at your own risk. 12. Indemnification You agree to indemnify and hold Whastafo harmless from claims arising due to: Your misuse of the platform Policy violations Legal disputes related to your messaging content 13. Changes to Terms We may update these Terms at any time. Continued use after changes implies acceptance. 14. Governing Law These Terms shall be governed by the laws of India.
