User Terms
Welcome to Whastafo. These Terms & Conditions (“Terms”) govern your access to and use of Whastafo, a WhatsApp API-based Software as a Service (SaaS) platform.
By creating an account or using Whastafo, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. Definitions
“Whastafo” refers to the WhatsApp API SaaS platform operated by us.
“User” refers to any individual or business using Whastafo.
“Services” include messaging, automation tools, APIs, dashboards, and related features.
“WhatsApp” refers to the WhatsApp Business Platform provided by Meta.
2. Eligibility
You must be at least 18 years old to use Whastafo.
You must provide accurate and complete information during registration.
Businesses must have legal permission and consent to message their customers.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials.
You are fully responsible for all activities under your account.
Any unauthorized use must be reported immediately.
Whastafo is not liable for losses caused by compromised accounts.
4. Use of Services
You agree to use Whastafo only for lawful purposes.
❌ Prohibited Activities:
Sending spam or unsolicited bulk messages
Messaging users without proper consent
Fraud, scams, phishing, or misleading communication
Adult, illegal, abusive, or hateful content
Violating WhatsApp/Meta policies
Reselling or sublicensing services without permission
Violation may lead to immediate suspension or termination of your account.
5. WhatsApp API Compliance
Users must comply with WhatsApp Business Platform policies.
Message templates require WhatsApp approval.
Message delivery depends on WhatsApp systems.
Whastafo is not responsible for:
Message rejections
WhatsApp account bans or restrictions
Policy violations caused by user content
6. Subscription, Billing & Payments
Whastafo operates on subscription and/or prepaid plans.
All payments are non-refundable.
Applicable taxes (including GST) may be charged.
Failure to pay may result in service suspension.
7. Data & Privacy
User data is handled according to our Privacy Policy.
Users retain ownership of their data.
Whastafo may store logs for analytics, security, and compliance.
8. Service Availability
We aim for high uptime but do not guarantee uninterrupted service.
Maintenance, upgrades, or outages may occur.
Whastafo is not liable for losses due to downtime or API failures.
9. Intellectual Property
All platform content, software, branding, and UI belong to Whastafo.
Users may not copy, modify, or reverse-engineer any part of the platform.
Unauthorized use of trademarks is strictly prohibited.
10. Account Suspension & Termination
Whastafo may suspend or terminate accounts if:
Terms are violated
WhatsApp policies are breached
Illegal or harmful activities are detected
Payments are not completed
Users may also terminate their account at any time.
11. Limitation of Liability
Whastafo shall not be liable for:
Indirect or consequential damages
WhatsApp account bans or restrictions
Message delivery failures
Business losses or revenue impact
Use of the platform is at your own risk.
12. Indemnification
You agree to indemnify and hold Whastafo harmless from claims arising due to:
Misuse of the platform
Policy violations
Legal issues related to your messaging content
13. Changes to Terms
We reserve the right to update these Terms at any time.
Continued use of the platform after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of India.
Any disputes shall fall under the jurisdiction of Indian courts.
